Merlin Media Magic ("we," "us," or "our") owns and operates merlinmediamagic.com and other sites linking to these Terms of Use (individually, the "Site", and collectively, the "Sites"). Through the Sites, Merlin Media Magic provides various offerings, information, and resources related to the products and services available on our Sites (each a "Service" and collectively, the "Services"). References to the Sites include the Services.

Merlin Media Magic may change, suspend, modify, or discontinue all or any part of the Sites in its sole discretion with or without notice. Merlin Media Magic is not liable if all or any part of a Site is, for any reason, unavailable at any time or for any period. Merlin Media Magic reserves the right to block or deny access to any of the Sites to anyone at any time for any reason.

General Terms

These Terms of Use are an agreement between Merlin Media Magic and the individuals that use the Sites ("users," "you," or "your"). The Terms of Use govern your access to and use of the Sites. By using or accessing the Sites, you represent and warrant that you are of legal age to accept these Terms of Use and form a binding contract with Merlin Media Magic.

PLEASE READ THE TERMS OF USE CAREFULLY. BY ACCESSING ANY PAGES ON THE SITES, CREATING AN ACCOUNT, OR USING ANY SERVICES, YOU EXPRESSLY AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS OF USE.

Changes to the Terms of Use

Merlin Media Magic reserves the right to update or modify the Terms of Use at any time, with or without prior notice. Any such changes will become effective upon the earlier of (i) the first time you use the Sites or Services with actual notice of the change(s), or (ii) 30 days after the change(s) are publicly posted on the Sites.

Account Access and Security

You may be required to register and create an account to access some content and functionality on the Sites. You are responsible for maintaining the confidentiality of your account, password, and other information. You agree to notify Merlin Media Magic immediately if you become aware of any unauthorized access to or use of your account.

User Content

The Sites may contain Services that allow you and others to post, submit, publish, display, or otherwise transmit various information and materials ("User Content"). You retain ownership rights in and to your User Content, and by posting User Content to the Sites, you grant Merlin Media Magic a non-exclusive, perpetual, royalty-free, worldwide license to use such User Content in connection with operating the Sites.

Content Standards

You agree that you will not post any User Content that:

  • infringes on or violates any intellectual property rights;
  • fails to comply with applicable laws and regulations;
  • contains expressions of hate, abuse, offensive images or conduct;
  • promotes violence or discrimination based on race, sex, religion, or other protected characteristics;
  • impersonates any person or entity; or
  • conflicts with these Terms of Use or any applicable law or policy.

Governing Law and Jurisdiction

All matters relating to the Sites and these Terms of Use shall be governed by and construed in accordance with the internal laws of the State of Arizona without giving effect to any choice or conflict of law provision.

SMS / Text Message Program Terms

These SMS terms are incorporated into and form part of the Merlin Media Magic Terms of Use above. By opting in to receive text messages from us, you agree to these terms.

Program Description

Merlin Media Magic sends SMS/MMS text messages to notify you about project updates, delivery notifications, appointment reminders, promotional offers, and other information related to our media production services. Messages are sent only to users who have explicitly opted in.

How to Opt In

You may opt in to receive SMS messages from us by providing your mobile phone number and checking the SMS consent checkbox during account registration at merlinmediamagic.com. Consent is never a condition of purchase or use of our services.

Message Frequency

Message frequency varies. You may receive up to 5 messages per month depending on your account activity and preferences. We do not send daily bulk messages.

Message & Data Rates

Msg & data rates may apply. Charges depend on your mobile carrier and plan. Merlin Media Magic does not charge separately for SMS messages, but your carrier's standard messaging and data rates will apply.

How to Opt Out (STOP)

You may opt out at any time by replying STOP to any message you receive from us. After replying STOP, you will receive one final confirmation message and no further SMS messages will be sent to your number. You may re-enroll at any time by texting START or by opting in again through our website.

Mobile Number Privacy & Data Sharing

Mobile opt-in data and consent will not be shared with any third parties or affiliates for marketing or promotional purposes under any circumstances. Your mobile phone number and SMS messaging consent are used solely to deliver the messages you have explicitly opted in to receive from Merlin Media Magic. We do not sell, rent, trade, share, or otherwise disclose your mobile number or consent status to any third party for their own marketing or commercial messaging purposes.

Supported Carriers

Our SMS program is supported by all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, Boost Mobile, MetroPCS, U.S. Cellular, and others. Carriers are not liable for delayed or undelivered messages.
